Wood Shop Policies

The Pelican Preserve wood shop is reserved for the use of Pelican Preserve residents for personal projects and is not for any commercial use. Use of the facility is restricted to those members of the community who have completed the proper release/acknowledgement forms and submitted them at the Soleil Health & Fitness Center and obtained the official shop card.

Wood Shop Rules

  1. The Facilities shall be open on the days and during the hours as may be established from time to time by WCI. 
  2. The Facilities are available for recreational use only by residents of the Pelican Preserve community.  The Facilities shall not be used for commercial or business purposes by residents or their guests.
  3. Every resident using the Facilities must execute a Woodshop Release, Waiver and Disclaimer of Liability and an Acknowledgment of Workshop Rules (collectively, the "Workshop Agreement") in order to receive a Pelican Preserve Workshop ID card.   
  4. The undersigned resident must present his or her Woodshop ID card and sign-in to gain access to the Woodshop during operating hours. No access will be available during non-operating hours.
  5. An operating booklet for the workshop equipment is available at the Facilities.  In addition, a copy of the operating booklet will be emailed to me at the email address provided below. The undersigned resident agrees to read the operating procedures prior to use of any equipment.
  6. Each resident, as a condition of use of the Facilities, assumes sole responsibility for his person and property and that of the resident’s guests and family members.  WCI shall not be responsible for any loss or damage to any private property used or stored at the Facilities. 
  7. All guests and/or family members must be accompanied by the undersigned resident. Property or furniture belonging to WCI shall not be removed from the Facilities, without proper authorization.  The undersigned resident shall be liable for any property damage and/or personal injury at the Facilities caused by the resident, any guest or any family member of the resident.  The cost of any damage may be charged to the undersigned resident's account.
  8. The undersigned resident agrees to clean up any debris created when using the Woodshop facilities or specific pieces of equipment.
  9. Additional rules and regulations for use of the Facilities may be posted at the Facilities.  WCI reserves the right to amend or modify rules and regulations for the use of the Facilities and will notify the residents or post any change. 

WOODSHOP RELEASE, WAIVER & DISCLAIMER OF LIABILITY

IN CONSIDERATION for the use of the woodshop facilities, equipment, programs, classes and the premises (collectively, the “Facilities”) located in the Town Center at Pelican Preserve in Lee County, Florida, owned by WCI Communities, LLC, a Delaware limited liability company, having a mailing address at 24301 Walden Center Drive, Suite #300, Bonita Springs, Florida 34134, and its parent, subsidiaries and affiliates (collectively, “WCI”), the undersigned, an individual having a mailing address at _____________________________________________ (the “Releasor”), and for other good and valuable considerations, the receipt and sufficiency of which are hereby acknowledged by the Releasor from or on behalf of WCI, the Releasor does hereby release, waive, disclaim and forever discharge WCI and all of its respective partners, affiliates and subsidiaries and their respective partners, directors, officers, agents, administrators, staff, employees, volunteers at the Facilities, shareholders, members, associates, personal representatives, successors, and assigns (collectively, the “Releasees”), of and from all, and all manner of action and actions, cause and causes of action, suits, torts, damages, judgments, executions, claims, demands, strict liability, breach of duties, negligence, personal injuries, warranties, representations, defects in workmanship, product liability, violations of state and federal law, claims and demands whatsoever, in law or in equity, which the Releasor ever had, now has, or may have, or which the Releasor or the Releasor’s personal representatives, successors, heirs or assigns and any minor children for whom the Releasor is a parent, grandparent, legal guardian, or otherwise responsible, hereafter can, shall or may have, against any or all of the Releasees for any matter whatsoever, from the beginning of time to the day of these presents, and further release, satisfy and forever discharge and hold harmless the Releasees, individually and collectively, from any or all of the above which may arise, result, occur or obtain subsequent to the day of these presents arising out of any act or omission by any or all of the Releasees, or otherwise, and relating to, among other things, the Facilities and the use of the Facilities by the Releasor.
The Releasor acknowledges having been informed that woodshop activities involve a risk of injury and even death and that the Releasor is voluntarily utilizing the Facilities with knowledge of the dangers and risks involved. The Releasor, on behalf of the Releasor and the Releasor’s personal representatives, successors, heirs or assigns and any minor children for whom the Releasor is a parent, grandparent, legal guardian, or otherwise responsible, acknowledges that there are risks, known and unknown, associated with the use of the Facilities and that the Releasor hereby expressly, knowingly and freely AGREES TO COMPLETELY AND ABSOLUTELY ASSUME ALL RISKS enumerated or referred to herein AND FULL RESPONSIBILITY FOR any and all personal injuries, accidents, damage, losses or illnesses, including death, loss of personal property which may occur, directly or indirectly, while using or as a result of having used any and/or all of the Facilities and further agrees to hold Releasees harmless from any and all claims relating to the Facilities and/or the use, maintenance and/or operation thereof.
The Releasor, on behalf of the Releasor and the Releasor’s personal representatives, successors, heirs or assigns and any minor children for whom the Releasor is a parent, grandparent, legal guardian, or otherwise responsibility, (a) hereby authorizes any medical treatment in the event of any injury while utilizing the Facilities and (b) acknowledges that the Releasor either has appropriate insurance or, in its absence, agrees to pay all costs of rescue and/or medical service as may be incurred on the Releasor’s behalf. This release, waiver and disclaimer specifically includes, but is not limited to, any and all claims, known and unknown, which may arise as a result of (a) negligence on the part of any or all of the Releasees, (b) the use of the Facilities which may break or malfunction in any manner for any reason, (c) lack or improper maintenance of the Facilities, (d) negligent, improper and/or incorrect supervision or instruction,(e) negligent, improper and/or incorrect use of the equipment and (f) slipping or falling by the Releasor for any reason while using the Facilities. This General Release and Waiver and Disclaimer of Liability shall be binding upon the Releasor’s heirs, personal administrators, executors and assigns.
I, THE RELEASOR, ON BEHALF OF MYSELF AND ANY MINOR CHILDREN FOR WHOM I AM A PARENT, GRANDPARENT, LEGAL GUARDIAN OR OTHERWISE RESPONSIBLE, HAVE READ THE FOREGOING ACKNOWLEDGMENT OF RISK, ASSUMPTION OF RISK AND RESPONSIBILITY AND RELEASE OF LIABILITY. I UNDERSTAND THAT, BY SIGNING THIS DOCUMENT, I MAY BE WAIVING VALUABLE LEGAL RIGHTS. I ACKNOWLEDGE AND SWEAR THAT I HAVE REACHED THE AGE OF MAJORITY AND, THEREFORE, AM ABLE TO ENTER INTO THIS RELEASE. I HAVE READ AND UNDERSTOOD THE ABOVE AND I HEREBY EXECUTE SUCH DOCUMENT ON THE ____ DAY OF______________________, 2012.
